HowLite Whitening, Inc.
Please read these terms and conditions, privacy policy and product disclaimer before purchasing or using HowLite Whitening, Inc.’s Teeth Whitening or other products.
Definitions:
“Site”: The website that is operated by HowLite Whitening, Inc. is howlitewhitening.com.
“Service”: HowLite Whitening, Inc. products and services.
“Content”: All information provided by HowLite Whitening, Inc. This can be in the form of writing, images, videos, or other works that you experience in any way on the Site.
“Terms of Use”: Information set forth herein.
“Agreement”: By use of this Site, the Service and information provided by HowLite Whitening, Inc. you agree to all your activity with HowLite Whitening, Inc. to be governed by the Terms of Use, Privacy Policy, Product Disclaimers in conjunction with the information included throughout the Site on relevant particular content, information pages and transactions.
“Submissions”: Any information, data, images, videos or material transmitted to HowLite Whitening, Inc. This may include, but not limited to, your first name, last name, approved photos of your teeth…etc.
The Terms:
HowLite Whitening, Inc. provides and operates The Site for the purpose of providing information about the Service the corporation provides and facilitating transactions with customers. By accessing this Site, you acknowledge your activity is governed by the Agreement. HowLite Whitening, Inc. reserves the right to amend, alter or modify this Agreement and its Terms of Use at any time without giving prior notice. It is your duty to check for any changes. Your use of this site following any changes you acknowledge your activity is still governed by the modified information of the Site. If you do not agree to these terms and conditions of use, please cease all further use of the site as you are not granted permission to use it.
Your Use of the Site
The Content on this Site is provided to give information about the Service provided by HowLite Whitening, Inc. You do not have permission to use any of the Content for commercial use or anything else other than for personal purposes. Whether the Content is accessed via the Site or by downloaded Content, no right, title, or interest in any Content is transferred to you. HowLite Whitening, Inc. reserves complete title and full intellectual property rights in all Content. Unless otherwise is stated in the Agreement documents, you are no permitted to copy, distribute, derive other work, transmit, use, or alter any of the Content.
You agree that you may not use the Site, Service or Content for any illegal purposes or n a manner that solicits any illegal activities, other activities which infringes the rights of HowLite Whitening, Inc. or other, or activities that hinders the operation of the site, renders it inaccessible or otherwise causes any damage to the Site or Content.
HowLite Whitening, Inc. Intellectual Property
The Site, Service, Contents and Agreement, along with the trademarks (such as, but not limited to HowLite Whitening, trade names, trade dress, slogans, service marks, the Content) and copyrights belong to HowLite Whitening, Inc. and are under protection of United States, United Kingdom, and foreign copyright laws. Unless otherwise permitted by law, you are not permitted to use the aforementioned without expressively written permission from HowLite Whitening, Inc.
Moreover, you acknowledge that nothing in the Agreement indicates that you may derive other work from or, transfer to you or any 3rd party, the ownership of any of the Site, Service, Contents and Agreement, along with the trademarks (such as, but not limited to HowLite Whitening, trade names, trade dress, slogans, service marks, the Content) and copyrights or any part thereof. HowLite Whitening, Inc. reserves the right to make any change to the Site, Service and/or Content at any time for any reason, except for anything agreed to in writing. Business use, high-volume or automated use of the Site or remailing is prohibited.
Any Content sent to you by HowLite Whitening, Inc., or Content that is configured to be downloaded can be (a) downloaded once to a single computer for personal, non-commercial use only, noting that you (b) must not alter or make any modifications to anything which belongs to HowLite Whitening, Inc. and you (c) must not use the Content provided in an illegal, unlawful or unethical manner or in a fashion that indicates association with HowLite Whitening, Inc.’s, its directors’, partners’ or employees’ brands, products or services.
User Submissions
Any Submissions made to HowLite Whitening will be considered non-confidential and non-proprietary. By transmitting any Submissions, you confirm and guarantee to us that (a) you are the owner of the content in the Submissions or have the permission of the owner to include the material in the Submission, (b) you have authority and consent of everyone who appears in the Submission to transmit the Submissions to us, (c) everyone who appears in the submissions are above the age of 18, if not, anyone who is under 18 years of age is a member of your immediate family, or under your authority and you have given consent and (d) that you have not violated any law or any person’s or entity’s rights by doing so. You also guarantee that you have the legal right to send the relevant Submissions. Furthermore, you acknowledge that by transmitting any Submissions to HowLite Whitening, Inc., you give HowLite Whitening, Inc. an irrevocable, global, perpetual and royalty-free right to copy, distribute, derive other work, transmit, use, and alter in any manner for media purposes, such as but not limited to, advertising, marketing, promotional, commercial and/or publicity without permission from you or further notice or payment to you or any other person or entity, in part or in whole and without any restriction or responsibilities to you. HowLite Whitening, Inc. will have the right to use your submissions to post on the Site, HowLite Whitening social media pages, such as but not limited to, Instagram, Facebook, Youtube, and/or affiliated websites.
HowLite Whitening, Inc. does not assume any liability from Submissions. Please pay attention and take care when making Submissions to only include information you are comfortable with making public. Submissions posted online can be viewed and shared by 3rd party users. Please read our Privacy Policy thoroughly to understand how HowLite Whitening, Inc. collects, uses, and alters personally identifiable Submissions.
You acknowledge that the terms in the Agreement are considered reasonably by both HowLite Whitening, Inc. and you (the customer). This includes but not limited to, the use of the Site, Service and Content by you and the use of Transmissions by HowLite Whitening, Inc. for its media purposes.
3rd Party Supplied Content
The HowLite Whitening, Inc. site may contain links to other 3rd party domains. The presence of 3rd party domain links is provided for ease of access for the domain user. In such instance, where the domain user clicks onto the 3rd party links, you acknowledge that HowLite Whitening, Inc. is not endorsing, sponsoring, or recommending the 3rd party site. The information on the 3rd party sites is not the property of HowLite Whitening, Inc. unless overtly stated. Subsequently, HowLite Whitening, Inc. is not responsible for the information exhibited within any 3rd party domain. This excludes HowLite Whitening, Inc. from any liability that may be stated by the domain user or otherwise implied. We recommend that upon leaving the HowLite Whitening domain, that the domain user read the privacy policies and terms of use provided by 3rd party websites, as they may vary within their trading, use and product standards.
Linking HowLite Whitening, Inc. Site to 3rd Party Sites
Subject to the guidelines of HowLite Whitening, Inc., it is possible to link our website. However, without special authorisation by HowLite Whitening, Inc., you may not create “deep links” associated with the domain. This includes, but not limited to; bypassing the HowLite Whitening, Inc. website pages such as homepage, creating false links, copycatting the website pages, adjusting the website interface.
Downloaded Material
Due to the prevalence of viruses, hacking and other harmful computer code, HowLite Whitening Inc. cannot and does not guarantee that the downloading of HowLite Whitening, Inc. files from the website will be free from tampering, infection or other forms of software breaches.
Software
All files and other software available for user download is copyrighted as the property of HowLite Whitening, Inc. and/or its affiliated licensors. The terms stated in the end user license agreement governs the use of HowLite Whitening Inc. software. The use of such software, through viewing, downloading, installing and such forth is indicative of your agreement to the terms of the end user license agreement.

DOES NOT ACCEPT ANY LIABILITY FOR ANY DIRECT, INDIRECT, ACCOMPANYING, INCIDENTAL, ACCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES THAT MAY OCCUR AS A CONSEQUENCE OF (A) TRANSACTIONS FACILITATED BY THE SITE, (B) CLAIMS CREDITED TO INACCURACIES, CHANGES, OR OMISSIONS IN THE SITE, SERVICE AND/OR CONTENT, (C) BOTH THE INABILITY TO USE AND THE USE OF THE SITE, SERVICE AND/OR CONTENT, (D) ALTERATIONS TO THE INFORMATION SUBMITTED IN THE TRANSMISSIONS, WHETHER BY HOWLITE WHITENING, INC., AND/OR AUTHORISED OR UNAUTHORISED 3RD PARTY ACCESS, AND/OR (E) ANY AND ALL MATTERS RELATING TO THE SITE, SERVICE AND/OR CONTENT UNDER ANY CIRCUMSTANCES, INCLUDING NEGLIGENCE. EXCLUSIONS FROM THE AFOREMENTIONED IN THE CASE OF HOWLITE WHITENING, INC. BEING ADVISED OF POSSIBLE DAMAGES BEFOREHAND DO NOT APPLY. YOU ACKNOWLEDGE YOU ARE SATISFIED AND AGREE TO THE ABOVE, THE SITE, SERVICE, CONTENT OR AGREEMENT. IN CASE YOU ARE NOT, YOU MUST CEASE ALL USAGE OF HOWLITE WHITENING, INC.’S SITE, SERVICE, AND/OR CONTENT. HOWLITE WHITENING, INC. RESERVES THE RIGHT TO TERMINATE FURTHER ACCESS TO THE SITE, SERVICE AND CONTENT TO ANYONE, IN ADDITION TO RESERVING THE RIGHT TO MAKE ANY CHANGES TO THE SITE, SERVICE AND/OR CONTENT AT ANY TIME AND FOR ANY REASON WITHOUT LIABILITY OR FURTHER NOTICE.
Indemnity
You agree to indemnify and, hold harmless from any demands, loss, liability, claims or expenses (including council’s and attorney’s fees), HowLite Whitening, Inc., its directors, shareholder, officers, agents, employees, 3rd party information providers and affiliates as a result of your use or misuse of the Site, Content, and/or Service whether directly or indirectly.
Governing Law; Dispute Resolution
The provisions in the Agreement are governed by and interpreted in accordance with the laws and consumer rights of the State of Delaware and the laws and consumer rights of the United States of America and applicable consumer rights, without conflicting with any provisions in the law. In the case any of the provisions in the Agreement are found to be illegal, unenforceable, or void, then that specific provision alone shall be deemed void, however, without affecting the authority, enforceability, and validity of the remaining provisions. You acknowledge and agree that any legal or equity action relating to or resulting from this Agreement, the Site or the Content shall be filled and processed in state or federal courts in Delaware, United States of America, hence, you hereby consent and submit to the personal jurisdiction of said courts for them to litigate any such action. Any claim under this Agreement must be brought within one (1) year after the cause of action arises, otherwise, such claim or cause of action is barred. In the event of any claim or dispute between you and HowLite Whitening, Inc. arising from the use of the Site or Content, the two parties shall attempt in good faith and hastily resolve such dispute within a reasonable amount of time (not exceeding thirty (30) days). If the dispute is not resolved in a reasonable amount of time, then either party have the right to submit such dispute for mediation. If mediation fails to resolve the dispute, either party shall have the right to pursue any right or remedy available to them under applicable law. In addition, you acknowledge and agree that HowLite Whitening, Inc. does not state that the Content, Site or Service is appropriate or available for use in any specific location. If you choose you view the Site, use the Service, you agree to the provisions in the documents in the Agreement and that you are responsible for your compliance with this Agreement, all applicable local, state, or federal laws.
Use of Personal Information
Personal information collected by HowLite Whitening, Inc. is done for the sole studying our customers’ preference in order to enhance both the Service provided and the Content for your use. Your information may also be used for media and promotional purposes. Please review all documents included in the Agreement for additional information.
HowLite Whitening, Inc. may use your provided email addresses to send out newsletters and other announcements containing information about its Service updates, new products, gift, promotions, competitions, and special features. You may opt out of these promotional materials at the time of placing an order, entering a competition, or signing up for our newsletter and promotional emails. If you would like to opt-out at a later date, it is possible to do so by referring to the instructions in the footnotes of HowLite Whitening, Inc. on how to do so.
Amendments
the following is subject to relevant applicable law and apply to the maximum extent permitted by such laws:
HowLite Whitening, Inc. reserves the right to amend, omit, add any provisions in the Agreement at its discretion and without further notice. HowLite Whitening, Inc. will notify its customers of any amendments to the Agreement by sending an email to the email address you last provided us with or by posting a notice on the Site. You are responsible for updating your personal information on our records and provide us with the correct and up to date email address. In case of failure to update your email address, and the current email address in HowLite Whitening, Inc.’s records is invalid or incapable of any way of delivering the notice of Agreement amendment to you, the dispatched notice email or Site notice post will still be considered an effective notice. Any amendment to these Terms of Use will be effective thirty days after either the sending of a notification to you as detailed above, or via posting notice of the changes on the site. Please note, any such amendment take effect thirty (30) calendar days following the dispatch of the notice email or the posting of the notice on the Site.
Termination of Your Use
The documents and provisions in the Agreement are in effect until terminated by either HowLite Whitening, Inc. or yourself. HowLite Whitening, Inc. reserves the right to terminate the Agreement with respect to you at our discretion for various reasons, such as but no limited to your access to the Site and Content if you are found to be in break of any of the provisions, failure to comply with any sections in the Agreement, if you are found to be involved in fraudulent, abusive or unlawful activities. HowLite Whitening, Inc. will also file a report against you such instances to the relevant law enforcement agencies. You may terminate your agreement and acknowledgments with the Agreement yourself at any time by discontinuing your use of the Site, Service, product and Content. Upon termination, you must cease any use of the Site, Content, or Service and discard any and all material, whether information, images, videos or any Content obtained from the Site or product obtained from the Service of HowLite Whitening, Inc.
